Terms and conditions of the Program

I Definitions

  1. Regulations – these regulations of the internal referral program in force at Arche Solutions Sp. z o.o. based in Katowice (postcode 40-112) at the address: ul. Morelowa 5, entered into the Register of Entrepreneurs kept by the District Court Katowice-Wschód in Katowice, 8th Commercial Division of the National Court Register under number KRS 0000679279;
  2. Referral program – a program in force at Arche Solutions Sp. z o.o., the purpose of which is to support the process of recruitment for technical positions carried out by Arche Solutions Sp. z o.o. Recruitment for graduate and other placements is excluded from the program;
  3. Referrer – an individual who recommends a candidate
  4. Referred person – an individual enrolled by the Referrer who has agreed to participate in the Referral program
  5. Effectively referred person – a person whose referral ended in employment or establishing cooperation with Arche Solutions Sp. z o.o.
  6. Settlement period – is a time interval expressed in months within which the referrals will be settled with regard to the effectiveness of the given Referrer’s referrals, with a view to granting the award;
  7. Qualified referral status – the status of a Referred person opening a recruitment process within Arche Solutions Sp. z o.o
  8. Non-qualified referral status – status of a Referred person which does not permit initiating the recruitment process at Arche Solutions Sp. z o.o
  9. Pilot period – 3month cooperation under an employment contract, contract of mandate, or B2B relationship between the Referred person and Arche Solutions sp. z o.o.
  10. Technical position – a position related to computer science and new technologies, involving: development or modification of computer software, analysis (IT or business), performing software implementation, software testing, database processing and analysis.

II General provisions

  1. The Regulations set out the rules for recommending individuals with a view to entering into employment or establishing cooperation with Arche Solutions Sp. z o.o.
  2. In particular, the Regulations set out:
    1. The terms for enrolling Referred persons.
    2. The manner in which Referred persons are enrolled under the Referral program.
    3. The list of Technical positions covered by the Referral program.
    4. The list of Referrers eligible to obtain a reward under the Referral program.
    5. The terms of payment of awards for successful referrals.
    6. The amount of the award under the Referral program.
  3. Within the Referral Program, the Referrer may not enroll themselves as a Referred person

III Referral rules

  1. The referral application process begins with the Referrer providing the Referred person’s CV via the form of Let’s Pass It on program LINK. The Referrer must provide the Referred person’s name, telephone number and e-mail address and attach their CV. Any other form of enrolment of a Referred person, or an incomplete enrolment, will be deemed ineffective.
  2. The Referred person will be asked by Arche Solutions to provide the necessary consents to the processing of personal data for the purpose of the recruitment procedure.
  3. A withdrawal of such consent to the processing of personal data by the Referred person in any regard shall make the application invalid and remove the data of the Referred person and the Referrer from the Referral program.
  4. The coordinator of the Referral program shall inform the Referrer and the Referred person of the status granted to the Referred person by e-mail within 2 working days of receipt of the application.
  5. The Referred person will be assigned the Non-qualified referral status if the Referred person has already been listed in the internal candidate database of Arche Solutions sp. z o.o.
  6. Non-eligibility for the program also happens if the Referred person is performing work, an assignment or providing services for a company with which Arche Solutions Sp. z o.o. is bound by a contract containing a clause preventing contact with such a person for the purpose of employment.
  7. Applications of Referred persons shall remain valid for 6 months, calculated from the date of receipt of the respective application by Arche Solutions Sp. z o.o.
  8. If the Referred person accepts a job, an assignment or starts providing services to a company with which Arche Solutions Sp. z o.o. is bound by a contract containing a clause preventing contact with a view to employing them, after the date of application and the granting of qualified status, the application of the Referred person shall be rendered void.
  9. The Referral program includes Technical positions
  10. In special cases, it is permissible to include referrals for other positions in the Program. The decision to include additional positions in the Referral program shall be taken by the Business Unit Manager or their deputy and informed in the manner accepted by Arche Solutions Sp. z o.o.
  11. The first contact on the part of persons acting on behalf of Arche Solutions Sp. z o.o. with the Referred person who has been granted the Qualified referral status will take place within 2 working days from the date of application.
  12. The employment or commencement of cooperation with the Referred person is dependent on a successfully completed recruitment procedure and the number of open vacancies at Arche Solutions Sp. z o.o.
  13. The settlement period falls on the 10th day of the month following the Pilot period.

III Referral rules

IV Awards

  1. The Referrer is entitled to an award for each successful referral in the amount of:
    • for a Referred person with more than 2 years of professional experience required for the given position – PLN 2000 gross
    • for a Referred person with more than 2 years of professional experience required for the given position – PLN 5000 gross
  2. An effective referral shall be deemed employment or establishing cooperation between Arche Solutions Sp. z o.o. and the given Referred person who has worked a minimum of 100 hours.
  3. The bonus will be paid in two parts:
    • The first half of the award – after the first month of the Referred person’s employment with Arche Solutions Sp. z o.o.
    • The second half – after the fifth month of the Referred person’s employment – if the Referred person continues to work at Arche Solutions Sp. z o.o.
  4. The award will be paid by the last day of the month following the Referred person’s pilot period.
  5. The award can be paid only if the Referrer remains in employment or cooperation with Arche Solutions Sp z o.o.
  6. The awards paid under the Referral program are subject to taxation in accordance with the applicable laws.
  7. Arche Solutions Sp z o.o. shall not be held liable if collection of the award is not possible for reasons attributable to a third party or the Referrer.
  8. The Referrer shall have the right to lodge a complaint in case of non-compliance with these Regulations. The complaint must be submitted no later than 5 working days from the date when Arche Solutions Sp z o.o. informed the Referrer of the decision on qualification for the Program. Complaints can be submitted electronically to the following e-mail address: office@stackmine.pl
  9. A written complaint should include:
    • full name and address of the person lodging the complaint;
    • a detailed description of the grounds for the complaint.
  10. Arche Solutions Sp z o.o. will investigate the complaint immediately, but no later than within 15 working days of its receipt. If a complaint cannot be investigated within 15 working days due to the complexity of the case or other circumstances beyond the control of Arche Solutions Sp z o.o., the complainant will be informed of this by Arche Solutions Sp z o.o.in the same form in which the complaint was made.
  11. Complaints sent to an incorrect e-mail address, past the deadline or ones that do not contain the required data will not be investigated.

V Additional information

  1. These Regulations shall come into force on 01 July 2022 and shall remain in force until Arche Solutions sp. z o.o. terminates the Referral program.
  2. Arche Solutions Sp. z o.o. reserves the right to terminate the Referral program at any time, with the reservation that the rights acquired by the Referrers shall remain unaffected. Employment or establishment of cooperation by Arche Solutions Sp. z o.o. during the validity period of the Referred person’s application past the validity period of the Referral program, effectively submitted within the validity period of the Referral program, shall be settled in accordance with the Regulations in force at the date of the Referred person’s application.
  3. The terms and conditions expressed in these Regulations may be amended or repealed by Arche Solutions Sp. z o.o. at any time, without giving any reason, while preserving the rights acquired by the Referrers.
